KASI KOUTURE – Terms & Conditions

Article 1 – Definitions

In these Terms & Conditions, the following definitions apply:

Cooling-off period: The period during which the consumer may exercise their right to withdraw from a purchase.

Consumer: Any natural person acting for purposes outside their trade, business, craft, or profession who enters into a distance contract with KASI KOUTURE.

Day: Calendar day.

Extended transaction: A distance contract relating to a series of products and/or services where delivery or purchase obligations are spread over time.

Durable medium: Any method that enables the consumer or KASI KOUTURE to store information addressed personally to them for future reference without alteration.

Right of withdrawal: The consumer's right to cancel a distance contract within the applicable withdrawal period.

Entrepreneur: KASI KOUTURE, the business offering products and services remotely to consumers.

Distance contract: A contract concluded exclusively through one or more means of remote communication.

Means of remote communication: Any method used to conclude an agreement without both parties being physically present.

Terms & Conditions: These General Terms & Conditions of KASI KOUTURE.

Article 2 – Right of Withdrawal

Consumers may withdraw from their purchase within 30 days of receiving their order without providing any reason.

During this period, consumers must handle both the product and its packaging with reasonable care.

If the right of withdrawal is exercised, products should be returned with all supplied accessories and, where reasonably possible, in their original packaging and condition, following the return instructions provided by KASI KOUTURE.

Article 3 – Applicability

These Terms & Conditions apply to every offer made by KASI KOUTURE and every distance contract concluded between KASI KOUTURE and the consumer.

Before an agreement is concluded, these Terms & Conditions will be made available to the consumer.

If any provision is deemed invalid or unenforceable, the remaining provisions shall remain fully effective.

Situations not specifically covered shall be interpreted in accordance with the intent and spirit of these Terms & Conditions.

Article 4 – The Offer

All offers made by KASI KOUTURE are non-binding and may be modified or withdrawn at any time.

While every effort is made to ensure product information is accurate:

  • Images are for illustration purposes only.

  • Colours may vary depending on monitor or mobile device settings.

  • Obvious pricing or typographical errors do not bind KASI KOUTURE.

Each offer clearly states:

  • Product price

  • Shipping costs (where applicable)

  • Accepted payment methods

  • Delivery information

  • Return eligibility

Article 5 – The Agreement

A purchase agreement is concluded once the consumer accepts the offer and successfully completes the checkout process.

KASI KOUTURE will confirm every order electronically.

We reserve the right to refuse or cancel orders where justified, including suspected fraud, payment verification issues, pricing errors, or product unavailability.

Article 6 – 30-Day Return Policy

Consumers may return eligible products within 30 days after receiving their order.

Conditions include:

  • A return request must be submitted within 30 days by email.

  • Returned items must be shipped within 30 days after approval.

  • Products should be unused where reasonably possible and returned in their original packaging.

  • Failure to notify KASI KOUTURE within the stated period will be regarded as acceptance of the purchase.

Article 7 – Return Costs & Refunds

Unless otherwise stated, return shipping costs are the responsibility of the customer.

Approved refunds will be processed within 30 days after the returned product has been received or valid proof of shipment has been provided.

Refunds will be issued using the original payment method whenever possible.

Article 8 – Exclusions from Returns

The right of withdrawal may not apply to:

  • Custom-made or personalised products.

  • Hygiene-sensitive products with broken safety seals.

  • Products that cannot be returned due to their nature.

  • Perishable or time-sensitive products.

Any exclusions will always be communicated before purchase.

Article 9 – Pricing

All prices displayed by KASI KOUTURE are subject to:

  • Typographical errors.

  • Currency fluctuations.

  • Changes in taxes or legal requirements.

KASI KOUTURE is not obligated to honour prices that are clearly incorrect due to obvious errors.

Article 10 – Product Conformity & Warranty

KASI KOUTURE guarantees that all products conform to their descriptions and meet reasonable quality standards.

Customers should report damaged, defective, or incorrect items within 30 days of receiving their order.

Warranty coverage does not apply where:

  • Products have been altered or repaired by unauthorised persons.

  • Damage results from misuse, negligence, accidents, or improper care.

Article 11 – Delivery & Fulfilment

KASI KOUTURE processes accepted orders with care and aims to dispatch orders within the advertised delivery timeframe.

Should delivery become significantly delayed or impossible:

  • Customers will be informed promptly.

  • Orders may be cancelled where appropriate.

  • Refunds will be issued where applicable.

Responsibility for the goods transfers to the customer once delivery has been successfully completed.

Article 12 – Payment

Payment must be completed using one of the payment methods offered during checkout.

Customers should notify KASI KOUTURE immediately if they identify payment errors or irregularities.

Where legally permitted, reasonable recovery costs may be charged for unpaid balances.

Article 13 – Complaints Procedure

Complaints regarding products or services should be submitted by email within 7 days after the issue has been identified.

KASI KOUTURE aims to respond within 14 business days.

Where additional investigation is required, customers will receive confirmation that their complaint has been received together with an estimated resolution timeframe.

Article 14 – Governing Law & Disputes

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Where applicable, consumers are protected under the Consumer Protection Act 68 of 2008 (CPA) and the Protection of Personal Information Act (POPIA).

Any disputes arising from purchases or the use of this website shall be subject to the jurisdiction of the competent courts of South Africa unless mandatory consumer protection legislation provides otherwise.
